Course Description:
During this 3-hour Law and Ethics presentation CAMFT Staff Attorney, Sara Jasper, will describe key issues to address at the outset of treatment with a particular emphasis on the importance of identifying the patient unit of treatment and setting up reasonable expectations within the patient unit. Ms. Jasper will talk about how this can be achieved through a discussion of patient goals, clarification of professional boundaries and competencies as well as key policies and procedures. Ms. Jasper will cover the No Surprises Act and how to discuss Medicare with patients now that LMFTs (and LPCCs) are Medicare eligible. Finally, Ms. Jasper to discuss additional issues to consider when treating patients with disabilities. The legal and practical information covered will help clinicians comply with their Americans with Disabilities (ADA) responsibilities. .

At the conclusion of this workshop, participants will be able to:
  • Identify fundamental issues to raise when establishing therapeutic relationships.
  • Identify the types of professionals and entities who/that must comply with the No Surprises Act (NSA) and the good faith estimate regulations
  • Describe the requirements for good faith estimates
  • Develop policies and practices that comply with the NSA and the regulations related to good faith estimates.
  • Use practical ideas and tips for how to address the topic of Medicare with patients.
  • Recognize and respond appropriately to legal requirements when establishing therapeutic relationships with clients who have communication disabilities.
