Course Description:
This 1.5 hour virtual workshop will identify key legal and ethical issues applicable to minors and confidentiality. Topics to be addressed include: recommended practices at the start of treatment; ethical standards applicable to confidentiality; The Confidentiality of Medical Information Act; key exceptions to confidentiality; limits of confidentiality when the minor's parents/guardians provide consent; limits of confidentiality when the minor provides consent; confidentiality involving use of insurance; access to minor patients' records; distinguishing confidentiality from psychotherapist-patient privilege; and discussion of vignettes involving minor confidentiality.

Learning Objectives:
 
At the conclusion of this workshop, participants will be able to:
  • Identify at least three sections of the CAMFT Code of Ethics which concern confidentiality
  • Identify a section of the California Health & Safety Code which addresses rights of access to a patient’s treatment record
  • Identify a section of the California Civil Code which permits a therapist to provide general updates  about a minor’s treatment to the minor’s parents
  • Identify one or more sections of the California Health & Safety Code or California Civil Code which express limitations on a parent’s rights of access to a minor’s treatment record
  • Describe two or more exceptions to confidentiality listed in the California Civil Code
  • Distinguish confidentiality from psychotherapist-patient privilege and provide an example which reflects the difference
  • Describe one or more practices when working with minors which help to minimize confusion or problems related to the issue of confidentiality

  • Michael Griffin, JD, LCSW

    Michael Griffin, JD, LCSW, is an attorney at law and a licensed clinical social worker.
    Mr. Griffin is a 1980 graduate of the USC School of Social Work and attended law school at Chapman University, where he earned his J.D. in 1998. He received his LCSW in 1982, is a Board Certified Diplomat in Clinical Social Work and has considerable experience as a psychotherapist working with children, adolescents, and adults.
    In addition to his experience as a therapist, Mr. Griffin has also worked as a clinical case manager, clinical supervisor, program director and as an oral examiner for LCSW candidates. Mr. Griffin served as a child/adolescent outpatient clinic director in the department of Psychiatry at Children’s Hospital and Health Center of San Diego and is the former Director of Clinical Operations for Western Youth Services in Orange County California. Mr. Griffin is a practicing psychotherapist and is an attorney with CAMFT, where he consults with CAMFT’s members regarding legal and ethical issues.
